Terms & Conditions

These Terms & Conditions (the “Terms”) govern your purchase of advertising space in The Yucaipa Spotlight (the “Publication”), a shared direct-mail postcard published by Chamber Grow (“Chamber Grow,” “we,” “us,” or “our”). By reserving a slot, submitting artwork, or completing checkout you agree to these Terms. If you do not agree, do not place a reservation.

1. What you are buying

You are purchasing a shared advertising slot on a printed postcard mailed to households within the Yucaipa, California coverage area shown on our website. You are not purchasing the postcard itself, exclusive distribution, a mailing list, or standalone artwork rights outside the Publication.

  • Slot size (small, medium, large, mega) and position (front/back, row, column) are as displayed at the time of reservation.
  • Term length equals the number of monthly mailings you selected at checkout.
  • Coverage area and household count are estimates and may vary from mailing to mailing based on postal routes and undeliverable addresses.

2. Category exclusivity

Each mailing features only one business per niche category, as determined by Chamber Grow in good faith. Category boundaries are set by us and our automated availability check; borderline or overlapping categories are decided at our discretion. If a conflict is discovered after purchase, we will (at our option) move you to the next available mailing, adjust your slot, or issue a refund for the affected mailing(s).

3. Reservations, payment, and slot hold

  • Reservations are made through our site and paid via our third-party payment processor (Stripe). Prices are shown in U.S. dollars and are exclusive of any applicable taxes.
  • A slot is temporarily held while you complete checkout. If payment is not completed within the hold window, the slot is released and may be claimed by another advertiser.
  • Your reservation is confirmed only when Stripe reports a successful payment and your reservation is marked paid in our system.

4. Deadlines for artwork and content

After payment, you will be directed to an onboarding form to submit your logo, photos, offer, copy, footer details, and other assets. To guarantee placement in a given mailing, all required content must be submitted no later than seven (7) calendar days before the mail date for that issue.

If required content is missing after this deadline, we may (at our option) run a placeholder using previously provided materials, move you to the next mailing, or reduce the term of your reservation without refund for the missed mailing.

5. Design, proofs, and approval

  • Our design team will create your ad from the assets you submit and email a proof for your approval before it goes to print.
  • You are responsible for reviewing the proof for accuracy of spelling, phone numbers, addresses, offers, hours, URLs, and any other facts. Once you approve a proof (or fail to respond within the timeframe stated in the proof email), the ad is final and locked for print.
  • Minor revisions are included. Substantial redesigns, added artwork, or changes after approval may be declined or subject to an additional fee at our discretion.

6. Your content and licenses you grant us

You represent and warrant that you own or have all necessary rights, permissions, releases, and licenses to submit every logo, image, name, likeness, trademark, testimonial, offer, and other material you provide, and that our use of those materials as contemplated by these Terms will not infringe any third-party rights or violate any law.

You grant Chamber Grow a non-exclusive, royalty-free, worldwide license to reproduce, adapt, print, distribute, display, and promote your submitted materials in the Publication and in marketing samples of the Publication (including on our website and social channels).

7. Content standards

We reserve the right to refuse, edit, or remove any content that we determine, in our sole discretion, is unlawful, misleading, defamatory, discriminatory, sexually explicit, related to firearms/tobacco/cannabis/adult services, or otherwise inconsistent with the family-friendly nature of the Publication. If content is refused after payment and cannot be revised, we will refund the unmailed portion of your reservation.

8. Cancellations and refunds

  • Before artwork approval: you may cancel by emailing us. We will refund any mailings that have not yet gone to print, minus a reasonable design fee if a proof has already been produced.
  • After artwork approval or after a mailing has gone to print: that mailing is non-refundable. Remaining unmailed months may still be refunded on the same basis.
  • We do not refund for missed deadlines, refusal to approve a proof, or changes you make to your business that render your ad unusable (closure, rebrand, phone/website changes, etc.).

9. Printing, mailing, and delivery

Mail dates are targets, not guarantees. Actual in-home dates depend on the United States Postal Service and are outside our control. Small variations in color, trim, and paper are inherent to offset/digital printing and are not defects. We do not guarantee any specific number of impressions, calls, visits, sales, or return on investment.

10. Disclaimer of warranties

The Publication and all related services are provided “as is” and “as available.” To the fullest extent permitted by law, Chamber Grow disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty of advertising results.

11. Limitation of liability

To the fullest extent permitted by law, Chamber Grow’s total liability arising out of or relating to your reservation or these Terms—whether in contract, tort, or otherwise—will not exceed the amount you paid to us for the specific mailing giving rise to the claim. In no event will we be liable for lost profits, lost customers, lost goodwill, or any indirect, incidental, consequential, special, or punitive damages.

12. Indemnification

You agree to indemnify and hold harmless Chamber Grow and its owners, employees, and contractors from any claim, loss, or expense (including reasonable attorneys’ fees) arising from (a) content you submit, (b) offers you advertise, (c) your business operations, or (d) your breach of these Terms.

13. Privacy

We collect only the information needed to fulfill your reservation: business details, contact information, payment confirmation from Stripe, and the assets you upload for your ad. We do not sell your information. Payment card data is handled entirely by Stripe under its own terms and privacy policy.

14. Changes to these Terms

We may update these Terms from time to time. The version in effect on the date you place a reservation governs that reservation. Material changes will be posted on this page with an updated “Last updated” date.

15. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state or federal courts located in San Bernardino County, California, and you consent to personal jurisdiction there.
